The Hostplus mobile application ('app') is an internet-based facility made available to all Hostplus members. It is provided by Host-Plus Pty Limited ABN 79 008 634 704, AFSL 244392 ('Hostplus', 'we', “us” or “our”) as trustee for the Hostplus Superannuation Fund ABN 68 657 495 890 , Level 9, 114 William Street, Melbourne VIC 3000. The following terms and conditions apply to your use of the app ('Terms').
Hostplus may revise these terms and conditions of use or update any content within the app at any time. We encourage you to check the terms regularly to stay informed of any changes and to ensure you have read and understood the most current version.

You may only use the app on a compatible mobile device, including iPhone and Android phones. The app is designed to provide a quick, easy, and convenient way to view and update the details of your superannuation account with us.
The app allows you to store your username, so you are not required to input it each time you log in. You acknowledge that by enabling this feature, you understand the risks associated with storing your username in the app. You are responsible for safeguarding the device that you use to access the app. While we have implemented security features into the app, we cannot guarantee the privacy, security and integrity of the app or any information entered by you on your device including the normal functions of using the app. We will not be liable for any loss or damage incurred as a result of any issues arising from the storing of your username on the app.
We use multi-factor authentication (MFA) protocols for information security purposes. MFA is a globally recognised security protocol.
In using MFA:
If you have a compatible iPhone or Android device, you may choose to enable biometric authentication, to log in to the app and confirm your identity using a biometric identifier registered on your mobile device instead of your email address/account number and password. A biometric identifier includes a fingerprint or facial data by which a mobile device manufacturer allows a user to authenticate their identity to unlocking their mobile device. This can be enabled or disabled anytime from the app settings. Hostplus does not collect or store your biometric identifier, which is stored within your mobile device.
Important: If you enable or use a biometric identifier to access the app, you must ensure that your biometric identifier is the only biometric identifier stored on the mobile device you use to access the app. If another person has stored their biometric identifier on the mobile device you use to access the app, you acknowledge that they may be able to access your accounts, including to view and conduct certain actions on the app, and these actions will be treated as having been authorised by you and conducted with your knowledge and consent.
This app contains copyright material, and brand names and other trademarks, that are protected by law. The app and its original content, features and functionality are and will remain the exclusive property of Hostplus and its third-party licensors. All names and logos are trademarks of the Trustee or third parties. Except as expressly authorised, the use of any material on the app (including reproduction, modification, distribution, republication, display or communication of any kind) is strictly prohibited.
Nothing in these terms constitutes a transfer of any intellectual property rights from us to you.

Hostplus collects personal information in order to administer your superannuation account and provide you with associated services and support. If you do not provide us with the information requested, we may not be able to carry out your instruction or provide the services or assistance you require. The Hostplus privacy policy is available on the Hostplus website at hostplus.com.au/about-us/legals/privacy or by calling us on 1300 467 875. The privacy policy explains how we handle your personal information, how you can access and/or seek correction of your personal information and how you can make a complaint about a breach of your privacy.
You agree to indemnify us and our successors and assigns for all damages, costs, expenses and other liabilities (including but not limited to legal fees and expenses) relating to any claim arising out of or related to your access to and use of the app or your breach of these Terms, except to the extent that the Loss was caused by us, or by any fraud, negligence or wilful misconduct by us (or our agents, employees, officers or contractors).
To the extent permitted by law, we exclude liability for all direct, indirect or consequential liabilities, losses, damages, costs and expenses (including, without limitation, loss of revenue, loss of goodwill, downtime costs, loss of profit, loss of or damage to reputation, loss under or in relation to any other contract, loss of data, loss of use of data or loss of anticipated savings or benefits), whether arising in contract, tort (including negligence) or otherwise, suffered or incurred by any person arising out of:
We may terminate or suspend your access to the app immediately, without prior notice or liability, for any reason whatsoever, including (without limitation) if you breach any of these terms.
We may also change all or part of the app (including the availability of any feature or content) or suspend access to the app at any time for any reason, and impose limits on certain features or restrict your access to all or part of the app, without having to give you notice.
All provisions of these terms which by their nature should survive termination will survive termination of your use of the app (whether we terminate your access or you discontinue using the app and delete it from your device).
The content of this app has been prepared for residents of Australia and as a result, all currency references are shown in Australian dollars. The app may be accessed throughout Australia and overseas. If you access the app outside of Australia, you do so at your own risk and are responsible for complying with the laws in each country you access the app. We do not accept any liability for accessing the app outside of Australia except as required by Consumer Law or to the extent that loss or damage is caused by any fraud, negligence or wilful misconduct by us (or our agents, employees, officers or contractors).
These Terms will be governed in all respects by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria, Australia and any courts of appeal from them.
Any failure by us to enforce any right under, or provision of, these Terms will not be considered a waiver of those rights. If any provision, or part of any provision, of these terms is held to be invalid or unenforceable by a court, that provision (or that part of a provision) may be severed from these terms and the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between you and us regarding the app, and supersede and replace any prior or subsequent agreements (whether in writing or verbal) between you and us regarding the app.
The operation and management of Hostplus are governed by a legal document known as the trust deed, as well as relevant legislation, including superannuation laws. In the event of any inconsistency between the information presented in the App and the provisions of the trust deed, the trust deed will prevail. You may request a copy of the trust deed by contacting us or you can view the trust deed on our website.
